Terms & Conditions

Please read these terms carefully before using our plumbing services or website. By engaging our services, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and USPlumbing Services ("USPlumbing," "we," "us," or "our"), a Texas limited liability company with its principal place of business at 1234 Commerce St, Suite 500, Dallas, TX 75201.

By requesting a quote, scheduling a service appointment, engaging our plumbing services, using our website at www.USPlumbing.nationassure.com (the "Site"), or using our mobile applications (the "Apps"), you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, which is incorporated herein by reference.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE OUR SERVICES, SITE, OR APPS.

Important: These Terms apply to both residential and commercial customers. For commercial projects exceeding $25,000, a separate Master Service Agreement (MSA) may be required. Contact our commercial team at commercial@USPlumbing.com.

2. Description of Services

USPlumbing provides a full range of plumbing services for residential and commercial customers throughout the United States, including but not limited to:

Emergency Repairs — Burst pipes, major leaks, flooding
Water Heater Services — Installation, repair, maintenance
Drain & Sewer Cleaning — Hydro-jetting, snaking
Leak Detection — Acoustic, thermal, camera
Remodeling Plumbing — Bathroom, kitchen, new construction
Sewer Line Services — Trenchless repair, CIPP lining
Sump Pump Services — Installation, repair, battery backup
Commercial Plumbing — Grease traps, backflow prevention

The specific scope of work for your service will be outlined in the written estimate or service agreement provided before work begins. USPlumbing reserves the right to modify the scope if unforeseen conditions are discovered during the course of work (see Section 4.3).

3. Service Area & Availability

Geographic Coverage: USPlumbing provides plumbing services in all 50 United States and Washington, D.C. Service availability may vary in remote, rural, or island locations (e.g., parts of Alaska, Hawaii, and US territories). We will notify you if we cannot service your location at the time of your request.
Service Hours: Standard service hours are Monday through Saturday, 7:00 AM to 8:00 PM local time. Emergency services are available 24 hours a day, 7 days a week, 365 days a year, including all US federal holidays.
Response Times: We target a 60-minute average response time for emergency calls and same-day/next-day scheduling for standard appointments. Response times are estimates and may vary based on demand, weather conditions, traffic, and your location.
Emergency Surcharge: Services performed outside standard hours (before 7:00 AM or after 8:00 PM weekdays, weekends, and federal holidays) may be subject to an emergency service surcharge, which will be disclosed before service begins.

4. Estimates & Pricing

4.1 Free Estimates

USPlumbing provides free on-site estimates for most standard plumbing services. Estimates are valid for 30 calendar days from the date issued, unless otherwise stated in writing. After 30 days, pricing may be adjusted due to changes in material costs, labor rates, or other factors.

4.2 Flat-Rate Pricing

Unless otherwise agreed in writing, all services are quoted on a flat-rate basis. The quoted price includes labor, standard materials, and applicable taxes. Flat-rate pricing means the price you approve is the price you pay — there are no hourly charges that can escalate.

4.3 Change Orders & Unforeseen Conditions

Plumbing work frequently involves hidden conditions behind walls, under floors, or underground. If our technician discovers conditions that were not reasonably identifiable during the initial estimate (e.g., hidden water damage, corroded pipes, code violations, asbestos, mold, or structural issues), we will:

  1. Stop work and document the condition (photos/videos)
  2. Provide you with a revised written estimate for the additional work
  3. Obtain your written or electronic approval before proceeding with any additional work

If you decline the additional work, you will only be charged for the work originally approved. However, we cannot guarantee the functionality or code compliance of the system if recommended additional work is declined.

4.4 Diagnostic / Trip Fees

In certain circumstances, a non-refundable diagnostic or trip fee may apply. This will always be disclosed before dispatch. If you proceed with the recommended repair, the diagnostic fee may be applied toward the total service cost at our discretion.

4.5 Material Upgrades

Estimates are based on standard-grade materials. If you request premium, designer, or upgraded materials (e.g., premium faucets, luxury fixtures, higher-grade piping), the price difference will be calculated and approved before installation.

Price Match: We offer a price match guarantee on written estimates from licensed plumbing competitors for identical scope of work. Contact us with the competitor's written estimate, and we will match or beat the price. Some restrictions apply — see our website for details.

5. Payment Terms

5.1 When Payment Is Due

  • Standard Services: Full payment is due upon completion of work, before our technician leaves the premises.
  • Projects Over $2,500: A deposit of 50% is required before work begins, with the remaining balance due upon completion.
  • Projects Over $10,000: A payment schedule will be outlined in a project agreement, typically structured as 40% deposit, 30% at midpoint, and 30% upon completion.
  • Emergency Services: Full payment is due at the time of service.

5.2 Accepted Payment Methods

Checks must be drawn on a US bank. We reserve the right to hold checks for up to 10 business days before considering funds cleared. A fee of $35 will be charged for any returned/bounced check or failed electronic payment.

5.3 Financing

We offer financing through third-party lending partners for qualifying customers on jobs over $500. Financing is subject to credit approval by the lender, not USPlumbing. Promotional terms (e.g., 0% APR for 18 months) are subject to change and may not be available in all states. USPlumbing is not a lender and does not make credit decisions. Contact us for current financing offers.

5.4 Late Payment

Past-due balances will incur a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by your state of residence, whichever is less. We reserve the right to suspend warranty coverage and refuse future service until past-due balances are resolved.

To cancel or reschedule, call us at (800) 555-1234. Cancellations must be confirmed by our dispatch team — leaving a voicemail or sending an email does not constitute a confirmed cancellation.

If our technician arrives and you are not present, or if access to the work area is not available as agreed, a no-show fee will apply. The technician will wait up to 15 minutes before departing.

7. Warranties

7.1 USPlumbing Workmanship Warranty

USPlumbing warrants that all plumbing services will be performed in a workmanlike manner in accordance with applicable plumbing codes. Our standard workmanship warranty covers labor and service for a period of two (2) years from the date of service completion.

7.2 Parts & Materials Warranty

Parts and materials installed by USPlumbing are covered by the manufacturer's warranty, which varies by product (typically 1 year to lifetime). We will assist you in filing any manufacturer warranty claims. If a manufacturer's warranty exceeds 2 years, the part is covered by the manufacturer only — not by USPlumbing's labor warranty.

7.3 Warranty Exclusions

This warranty does NOT cover:

  • Damage caused by misuse, abuse, negligence, or accidental damage after installation
  • Issues caused by frozen pipes due to inadequate winterization or heating failure
  • Problems arising from modifications or repairs performed by third parties after our service
  • Normal wear and tear, cosmetic issues, or deterioration from normal use
  • Damage from acts of God, natural disasters, or environmental conditions beyond our control
  • Issues in areas not included in the original scope of work
  • Warranty is void if payment has not been received in full

7.4 Warranty Claims

To make a warranty claim, contact us at (800) 555-1234 or warranty@USPlumbing.com with your service order number. We will schedule a inspection within a reasonable timeframe. If the issue is covered under warranty, we will repair it at no charge for labor. If the issue is not covered, we will provide a paid repair estimate.

8. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY AND AFFECTS YOUR LEGAL RIGHTS.

8.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USPlumbing SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: property damage beyond the immediate work area, loss of use, loss of income, business interruption, water damage to personal property, mold damage, or any other damages arising out of or related to our services, regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if USPlumbing HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 Cap on Direct Damages

IN NO EVENT SHALL USPlumbing'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO USPlumbing FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM, OR (B) $10,000.

8.3 Pre-Existing Conditions

USPlumbing is not responsible for pre-existing conditions, including but not limited to: pre-existing water damage, mold, corrosion, code violations, or substandard work by previous contractors. While we will make reasonable efforts to identify and communicate such conditions, we cannot guarantee discovery of all hidden defects.

8.4 Third-Party Products

USPlumbing is not the manufacturer of any parts, fixtures, or materials installed during service. Our liability for defective products is limited to replacing the product under the manufacturer's warranty. We make no additional warranties, express or implied, regarding third-party products.

Some states do not allow the exclusion or limitation of consequential or incidental damages, so the above limitations may not apply to you. In such states, our liability shall be limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless USPlumbing, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your breach of any provision of these Terms
  • Your negligence or willful misconduct in connection with our services
  • Any misrepresentation you make regarding your property, plumbing system, or service request
  • Any injury to persons or damage to property caused by your failure to maintain safe conditions on the premises during our service
  • Any violation of law by you in connection with our services

This indemnification obligation will survive the termination or expiration of these Terms.

10. Insurance & Permits

10.1 Our Insurance

USPlumbing maintains the following insurance coverage at minimum levels:

10.2 Permits & Code Compliance

USPlumbing is responsible for obtaining all necessary permits required for the work performed, unless otherwise agreed in writing. All work will be performed in compliance with the applicable plumbing code for your jurisdiction, including but not limited to the International Plumbing Code (IPC), Uniform Plumbing Code (UPC), and any local amendments. Permit fees are included in the quoted price unless otherwise stated. Inspection scheduling is the responsibility of USPlumbing; however, the customer must provide access for municipal inspections as needed.

10.3 Customer's Insurance

We strongly recommend that you maintain adequate homeowner's or property insurance coverage. USPlumbing is not responsible for any damage to your property that exceeds the limits of our liability as set forth in Section 8, regardless of whether you carry insurance.

11. Customer Obligations

By engaging our services, you agree to:

  • Provide Accurate Information: Accurately describe the plumbing issue, property type, and any relevant details (e.g., age of plumbing system, prior repairs, known issues).
  • Secure Pets: Secure all pets in a separate room or area away from the work location during service.
  • Clear Work Area: Remove personal belongings, furniture, and obstructions from the area where work will be performed. USPlumbing is not responsible for damage to items left in the work area.
  • Maintain Safe Premises: Ensure the property is safe for our technicians, including adequate lighting, safe walkways, and disclosure of any hazards (asbestos, mold, structural issues, etc.).
  • Water Shut-Off: Know the location of your main water shut-off valve and be prepared to shut off water if directed by our technician in an emergency.
  • Supervise Minors: Children under 18 must be supervised by a responsible adult and kept away from the work area and tools.
  • Approve Work: Provide approval (written, electronic, or verbal recorded) before any work begins and before any change orders are executed.

12. Property Access & Abandoned Work

An adult (18 years or older) must be present at the property for the duration of all services, unless prior written arrangements have been made (e.g., commercial properties with property manager authorization, or pre-arranged lockbox access for specific limited services).

If our technician arrives and no authorized person is present to provide access, the appointment will be considered a no-show (see Section 6), and applicable fees will apply.

If work is commenced but you are unavailable to approve change orders or final inspection, work may be paused. If work remains paused for more than 30 days without communication from you, the work will be considered abandoned. You will be responsible for payment for all work completed to date, and any materials purchased specifically for your project will be charged to you.

13. Intellectual Property

All content on the Site and Apps, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, software, and the design and arrangement thereof (collectively, "Content"), is the exclusive property of USPlumbing or its licensors and is protected by US and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Content without our prior written consent, except as follows:

  • You may temporarily store copies of Content in RAM incidental to your accessing and viewing the Site
  • You may store files that are automatically cached by your web browser
  • You may print or download one copy of a reasonable number of pages for personal, non-commercial use

The "USPlumbing" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of USPlumbing Plumbing Services LLC. You may not use these marks without our prior written permission.

14. Website Use & User Conduct

When using our Site or Apps, you agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law
  • Submit false, misleading, or fraudulent service requests or information
  • Attempt to gain unauthorized access to any portion of the Site, user accounts, or our systems
  • Use robots, scrapers, or other automated means to access the Site without our permission
  • Transmit any viruses, malware, or other harmful code
  • Interfere with or disrupt the Site's functionality, servers, or networks
  • Post or submit any content that is defamatory, obscene, threatening, or harassing

We reserve the right to terminate or restrict your access to the Site at any time, without notice, for any violation of these terms.

15. Dispute Resolution

Binding Arbitration & Class Action Waiver: This section contains a binding arbitration agreement and class action waiver that may affect your legal rights. Please read it carefully.

15.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at disputes@USPlumbing.com or (844) 834 0952 to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved within 30 days, either party may proceed to formal dispute resolution.

15.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator and shall take place in Dallas County, Texas, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND USPlumbing EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against USPlumbing. If a court or arbitrator determines that this class action waiver is unenforceable, the entirety of this Dispute Resolution section shall be deemed void.

15.4 Exceptions — Small Claims Court

Notwithstanding the above, either party may bring an individual claim in small claims court, so long as the claim is brought in an individual capacity and not as a class or representative action, and the small claims court does not permit class actions or consolidation.

15.5 Opt-Out Right

You have the right to opt out of this binding arbitration agreement within 30 calendar days of the date you first accept these Terms. To opt out, you must send a written notice to: USPlumbing Plumbing Services LLC, Attn: Legal Department, 1234 Commerce St, Suite 500, Dallas, TX 75201, or email legal@USPlumbing.com, with the subject line "ARBITRATION OPT-OUT" and including your name, address, phone number, and email address.

16. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For any disputes not subject to arbitration (e.g., small claims court, or if the arbitration agreement is found unenforceable), you agree to exclusive jurisdiction in the state or federal courts located in Dallas County, Texas. You consent to the personal jurisdiction of such courts and waive any objection to venue therein.

Notwithstanding the above, to the extent that any applicable state consumer protection law provides greater protection to you than Texas law, such state law shall apply to any dispute arising from services performed in that state.

17. Force Majeure

USPlumbing shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters (hurricanes, earthquakes, floods, tornadoes), pandemics, epidemics, government actions or orders, war, terrorism, civil unrest, labor disputes or shortages, supply chain disruptions, utility failures, severe weather conditions, road closures, or other circumstances that make it unsafe or impractical to perform services.

In the event of a force majeure, we will use reasonable efforts to resume performance as soon as practicable, notify you of the delay, and offer to reschedule at a mutually convenient time. We will not charge cancellation fees for force majeure events.

18. Modifications to Terms

USPlumbing reserves the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes:

  • We will update the "Effective" date at the top of this page
  • We will post a notice on our website homepage for at least 30 days
  • We may send an email notification to registered users

Changes to these Terms will apply prospectively. Your continued use of our services after the effective date of changes constitutes your acceptance of the revised Terms. For scheduled services, the version of these Terms in effect at the time of booking will govern that service.

19. Severability & Entire Agreement

19.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. Notwithstanding the foregoing, if the class action waiver in Section 15.3 is found unenforceable, the entire Dispute Resolution section (Section 15) shall be void.

19.2 Entire Agreement

These Terms, together with the Privacy Policy and any written service agreement or estimate executed between you and USPlumbing, constitute the entire agreement between you and USPlumbing regarding the subject matter hereof, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision.

19.3 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. USPlumbing may assign these Terms to any affiliate, successor, or purchaser of all or substantially all of our assets, without your consent, provided that the assignee agrees to be bound by these Terms.

19.4 Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND USPlumbing EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LITIGATION ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES.

Acknowledgment

By scheduling a service, you confirm the following

I have read, understand, and agree to be bound by these Terms & Conditions and the Privacy Policy.
I understand that I am entering into a legally binding agreement with USPlumbing Services LLC, a Texas limited liability company.
I understand the limitation of liability provisions in Section 8, the binding arbitration and class action waiver in Section 15, and the governing law provisions in Section 16.
I understand that I have 30 days from the date I first accept these Terms to opt out of the binding arbitration agreement by following the procedure in Section 15.5.
I represent that I am at least 18 years of age and have the legal authority to enter into this agreement on behalf of myself or the property owner.
